Terms of Use for CrossPost Pro

These Terms of Use apply to the CrossPost Pro iOS app, the associated backend services, the website, and all functions used to prepare, upload, process, and publish content on third-party platforms.
Conflicting or supplementary terms of users apply only if the provider expressly agrees to them. Mandatory statutory rights of consumers remain unaffected.
2. Service description
CrossPost Pro is a technical publishing tool. In particular, the app enables:
- selecting or importing videos from Photos or Files,
- local preparation, preview, cover/thumbnail selection, and text/tag management,
- connecting YouTube, Instagram, and TikTok accounts via OAuth or the respective platform integration,
- uploading media to the CrossPost Pro backend, technical conversion, and temporary provision,
- publishing the content selected by the user with the selected settings on the selected platforms,
- optional support and error-reporting functions.
CrossPost Pro is not a social network, public media catalog, or content-moderation service. The temporary public availability of media is used exclusively for technical publication and retrieval by selected platforms.
3. Eligibility and target audience
CrossPost Pro may only be used by persons who are at least 18 years old. Use by minors is not permitted.
The service may be used by private users and business users. In the case of business use, the user represents that they are authorized to use the relevant company, creator, or social-media account.
Use of certain functions requires a compatible iOS device, internet access, an Apple Account, App Store availability, valid social-media accounts, and acceptance of the terms of the relevant third-party platform.
4. Trial period, subscription, payment, cancellation, and refunds
CrossPost Pro can be used free of charge for 30 days from the first use of the app. After this free-use period expires, continued use of paid functions requires a subscription.
Subscriptions are processed exclusively through the Apple App Store or StoreKit. The provider does not process payment data and does not operate its own payment service. The prices, terms, taxes, and conditions shown in Apple's purchase dialog are decisive. According to the operator, subscriptions for 1 month and 3 months are configured in App Store Connect; the specific local prices may vary depending on country, currency, taxes, and Apple price tier and are displayed by Apple before purchase.
Subscriptions renew in accordance with Apple's terms unless they are canceled through Apple in time. Cancellation, management, and refunds are handled by Apple, in particular through the iOS App Store > profile picture > Subscriptions menu or through the support and "Report a Problem" functions provided by Apple.
Because CrossPost Pro subscriptions are not sold through the website and payment is made exclusively through the App Store, CrossPost Pro does not provide its own website cancellation button for App Store subscriptions. Mandatory consumer rights, withdrawal rights, warranty rights, and refund rights under applicable law remain unaffected.
5. Platform accounts, OAuth, and third-party platform terms
To publish on YouTube, Instagram, or TikTok, the user must authorize the relevant platform account. Authorization takes place through OAuth, the TikTok SDK integration, or comparable platform processes. In production, CrossPost Pro stores the platform tokens required for the function in encrypted form and may refresh them to the extent required to provide publication.
The user can disconnect linked platform accounts in the app. CrossPost Pro attempts to trigger platform-side token revocation where the relevant platform technically supports this; the local connection in the CrossPost Pro backend is then deleted.
The user is responsible for complying with the terms, community rules, advertising rules, music rules, branded-content rules, copyright rules, and API requirements of the selected platform. This includes, in particular, the terms and policies of YouTube/Google, Meta/Instagram, and TikTok.
6. User content, rights, and license
The user remains the owner of their content. However, the user grants the provider a simple, non-exclusive, worldwide, royalty-free right limited to contract performance to store, copy, technically process, convert, create preview images or covers from, make temporarily publicly accessible, transmit to the platforms selected by the user, and publish with the selected settings the content and metadata provided by the user.
This license exists only to the extent required for operation, publication, troubleshooting, security, legal enforcement, and compliance with statutory obligations. With respect to productive media processing, it ends at the latest when the content is deleted from the active systems, subject to technically limited backup cycles, logs, statutory retention obligations, and content that has already been transferred to third-party platforms.
The user represents that they have all required rights, consents, and clearances, in particular for video, audio, music, trademarks, logos, texts, images, depictions of persons, voices, and other personal data. Content containing personal data of third parties, minors, or special categories of personal data may only be uploaded or published if a valid legal basis and all required consents exist.
7. Prohibited use
The user may not use CrossPost Pro for:
- illegal content or actions,
- copyright, trademark, personality-rights, data-protection, or confidentiality violations,
- content that promotes or depicts violence, hate, extremism, terrorism, discrimination, sexual exploitation, child abuse, or other serious legal violations,
- spam, deception, fraudulent activities, phishing, malware, automated mass use, or circumvention of technical protection measures,
- publications that violate platform terms, music rules, advertising rules, branded-content rules, or creator rules,
- attempts to misuse, scrape, disrupt, overload, or circumvent the backend, APIs, public media URLs, legacy routes, or platform integrations.
The provider is not generally obliged to monitor content in advance. However, where there are indications of legal violations, security risks, platform violations, or breaches of contract, the provider may remove content, restrict access, cancel publications, disconnect platform connections, or exclude users from the service.
8. Temporary public media URLs
To enable platforms such as Instagram or TikTok to technically retrieve media, CrossPost Pro may create temporary public media URLs. These URLs are not intended as a public feed, search service, or permanent publication. However, they are technically accessible without login while they exist. Anyone who knows the URL can retrieve the associated media file during its availability.
The user may not use such URLs as permanent hosting links or share them with unauthorized third parties. Uploaded media, covers, conversions, and temporary URLs are deleted after no more than 14 days. Content that has already been transferred to third-party platforms is then subject to the deletion, visibility, and usage rules of the respective platform.
9. Availability, support, updates, and changes
The provider makes CrossPost Pro available with reasonable care. Continuous availability, specific upload or publication times, permanent compatibility with third-party platform APIs, or a specific publication result are not guaranteed.
Functionality may depend on Apple, YouTube/Google, Meta/Instagram, TikTok, operating-system versions, API approvals, platform reviews, account permissions, network connections, and platform content reviews. Third-party platforms may change, restrict, or discontinue functions, APIs, permissions, or policies.
The provider may change, update, add, restrict, or remove CrossPost Pro functions where this is required or reasonable for security, legal compliance, platform requirements, technical improvement, or economically viable operation. Where changes require express consent under mandatory law, amended terms become binding only after the required consent has been obtained.
Support is provided without any guaranteed response time unless a separate agreement exists.
10. Suspension, restriction, and termination
The user may stop using the service at any time, delete the app, disconnect platform accounts, and request deletion of personal data in accordance with the Privacy Policy. App Store subscriptions must be canceled separately through Apple.
The provider may temporarily or permanently restrict access if there are specific indications of legal violations, security risks, misuse, platform violations, breaches of these Terms, lack of payment/subscription entitlement, or official or court requirements. The legitimate interests of the user will be appropriately taken into account.
11. Contact point and reporting channel for illegal content
Notices of illegal content, misuse, rights violations, or security issues may be sent to bastian.aunkofer@gmail.com. This address also serves as an electronic contact point for users and authorities in connection with CrossPost Pro, to the extent legally applicable. Communication is possible in German or English.
A report should include: the specific URL or identifier of the affected content, a reason why the content is alleged to be illegal or in breach of contract, the name and contact details of the reporting person where legally permissible, and a statement that the information is correct and complete to the best of the reporting person's knowledge.
The provider reviews substantiated reports and takes appropriate measures, such as removal, blocking, restriction, inquiry with the user, or rejection of the report. Clearly unfounded or abusive reports may be rejected.
12. Warranty and liability
For consumers, statutory warranty rights for digital products and digital services apply without restriction. Mandatory rights under the law of the consumer's country of residence remain unaffected.
The provider has unlimited liability for intent and gross negligence, injury to life, body, or health, under the Product Liability Act, for fraudulent concealment of a defect, and for guarantees assumed.
In the event of slightly negligent breach of essential contractual obligations, the provider is liable only for foreseeable damage typical for the contract. Essential contractual obligations are obligations whose fulfillment makes proper performance of the contract possible in the first place and on whose compliance the user may regularly rely. Otherwise, liability for slight negligence is excluded to the extent permitted by law.
The provider is not liable for user content, for deletions, suspensions, reach restrictions, reviews, API changes, or publication decisions made by third-party platforms, to the extent the provider is not responsible for them.
Toward entrepreneurs, the user indemnifies the provider against third-party claims arising from a culpable breach of these Terms, third-party rights, or statutory obligations by the user. Toward consumers, this applies only in accordance with statutory provisions.
13. Applicable law, jurisdiction, and consumer dispute resolution
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only to the extent that it does not deprive them of the protection of mandatory provisions of the law of the state in which they have their habitual residence.
If the user is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is, to the extent legally permissible, the provider's registered office. For consumers, the statutory places of jurisdiction apply.
The provider is neither obliged nor willing to participate in dispute-resolution proceedings before a consumer arbitration board.
If any provision of these Terms is or becomes invalid, the validity of the remaining provisions remains unaffected.
